These Terms of Use explain the rules for using Fundraising Shopping Cart, including seller registration, online shopping, order processing, delivery options, and support requests.

1. Agreement to These Terms

By using Fundraising Shopping Cart, registering a seller, logging into a seller account, placing an order, checking order status, or submitting a contact form, you agree to these Terms of Use. If you do not agree, please do not use this website.

2. Purpose of This Website

Fundraising Shopping Cart is provided to help schools, teams, groups, organizations, sellers, parents, supporters, and shoppers participate in online fundraising programs. The website may be used for seller registration, seller login, product browsing, online ordering, order status lookup, receipts, and customer support.

3. Seller Registration and Accounts

Seller accounts should be created using accurate information and the correct Group ID provided by the fundraiser coordinator, school, team, group, or organization. Seller Online IDs and passwords should be kept private and used only for the fundraiser they were created for.

Parents, guardians, schools, groups, organizations, or fundraiser coordinators may assist youth sellers with registration and account access. You are responsible for keeping login information secure and for notifying us if you believe an account has been accessed without permission.

4. Shopper Responsibilities

Before placing an order, shoppers are responsible for entering the correct Seller Online ID, reviewing the seller and organization being supported, selecting the correct items, and providing accurate billing, shipping, contact, and delivery information.

If you believe you entered the wrong Seller Online ID, shipping address, email address, or order information, please contact us as soon as possible. Changes may not be possible after an order has been processed, shipped, or included in a group delivery.

5. Product Information, Pricing, and Availability

We work to display accurate product information, item numbers, pricing, images, descriptions, taxes, shipping, and processing fees. However, errors may occur, and product availability may change. We reserve the right to correct errors, update product information, cancel unavailable items, or adjust an order if necessary.

Product images are for general reference and may not perfectly match the final item, packaging, size, color, or presentation.

6. Online Orders and Payment

Orders are not complete until payment is submitted and accepted. Payment processing may be handled by third-party payment service providers. By submitting payment, you authorize the applicable charges for the items, taxes, delivery fees, processing fees, and any other charges shown during checkout.

If a payment is declined, reversed, disputed, or otherwise not completed, the order may be delayed, canceled, or require additional review.

7. Delivery Options

Available delivery options depend on the fundraiser, products, order contents, delivery area, and timing. Some orders may be eligible for home delivery, while others may be delivered through the school, team, group, or organization after the fundraiser is complete.

School or organization delivery means the order is delivered with the fundraiser’s group order instead of being shipped directly to your home. Distribution timing and pickup details may be handled by the group or fundraiser coordinator.

8. Shipping, Address Accuracy, and Delivery Issues

For home delivery orders, you are responsible for providing a complete and accurate shipping address. Address verification tools may be used, but they do not guarantee delivery or prevent every address issue.

If a package is delayed, returned, refused, undeliverable, or shipped to an incorrect address because of incorrect information provided during checkout, additional charges or limitations may apply. Please contact us quickly if you notice an address mistake.

9. Order Changes, Cancellations, and Replacements

Order changes or cancellations may not be possible once an order has been processed, submitted for fulfillment, shipped, or included in a group delivery. If you need help, contact us as soon as possible with your order details.

If you receive a wrong, missing, or damaged item, please reply to your receipt or use the Contact Us page. Include the order number, purchaser name, seller name, item number, and a short description of the issue so we can review it.

10. Fundraiser Credit and Seller Totals

Online orders are credited based on the Seller Online ID or fundraiser information entered during the shopping process. We are not responsible for incorrect fundraiser credit caused by entering the wrong Seller Online ID or selecting the wrong seller, but we will do our best to help if you contact us quickly.

Prize programs, seller rewards, delivery timing, distribution rules, and fundraiser-specific details may be determined by the school, team, group, organization, or fundraiser coordinator.

11. Acceptable Use

You agree not to misuse this website. Prohibited activity includes attempting to access accounts without permission, submitting false information, interfering with website operation, probing for security weaknesses, using automated tools in a harmful way, sending spam, uploading malicious content, or using the cart for non-fundraising or unlawful purposes.

12. Website Availability

We work to keep the website available and functioning, but we do not guarantee uninterrupted access. The site may be unavailable because of maintenance, updates, hosting issues, security events, internet disruptions, payment provider issues, or other circumstances beyond our control.

13. Third-Party Services

The website may use third-party services for payment processing, email delivery, hosting, security, analytics, shipping, address verification, and other operational needs. We are not responsible for every action, delay, or issue caused by third-party services, but we work to resolve problems when they affect fundraising orders or support.

14. Intellectual Property

The website design, text, graphics, logos, product images, icons, software, and other materials are owned by or licensed to Fundraising Shopping Cart, Midland Fundraising, or their respective owners. You may not copy, modify, distribute, reuse, or republish site materials except as allowed for normal fundraiser participation or with written permission.

Your use of this website is also governed by our Privacy Policy, which explains how information is collected, used, shared, and protected.

16. Disclaimers

This website is provided on an “as available” basis. We make reasonable efforts to provide accurate information and reliable service, but we do not guarantee that the website, product information, pricing, availability, delivery estimates, or support information will always be error-free or uninterrupted.

17. Limitation of Liability

To the fullest extent allowed by law, Fundraising Shopping Cart, Midland Fundraising, and their owners, employees, service providers, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website, order delays, website interruptions, delivery issues, incorrect information submitted by users, or third-party service issues.
